NitoPath Terms of Service

These terms are an agreement between you and NitoPath ("we", "us") covering your use of the NitoPath app and related services (the "Service").

By tapping to accept, creating an account, or using the Service, you agree to these terms. If you do not agree, do not use the Service.

1. Who may use NitoPath

You must be at least 18 years old to use the Service. The Service is not directed to children and we do not knowingly collect information from anyone under 18.

If you use the Service while operating a vehicle, you must hold a valid driver licence and carry any insurance the law requires where you drive.

You may not use the Service if the law where you are prohibits it, or if we have previously suspended your account.

2. What NitoPath is — and is not

NitoPath is an informational navigation aid. It shows the locations of automated licence plate readers (ALPRs) that volunteers have recorded in OpenStreetMap, and it can plan driving routes that pass fewer of them or that pass more of them, whichever you choose. People use it in both directions: some prefer fewer cameras, others prefer to travel on monitored roads.

Camera data is crowdsourced and is always incomplete, and it may be wrong, outdated, or missing entirely. A route the app describes as having no known cameras may still pass cameras that nobody has mapped, cameras that were installed recently, or mobile and temporary cameras. Surveillance may also occur through means the app knows nothing about.

Whichever mode you use, the Service does not make you anonymous, does not prevent you from being recorded, photographed or identified, does not defeat any surveillance system, and does not make any route safe. Do not rely on it for safety, for privacy, or for any legal purpose.

Routes, distances, travel times and arrival estimates are estimates only. Roads, closures, traffic, construction and restrictions change constantly and the Service will not always know about them.

3. Safe driving is your responsibility

Always obey traffic laws, road signs, signals, speed limits, and the instructions of law enforcement and road crews. Real-world conditions and posted signs always take priority over anything the app shows or says.

Do not type, read, or interact with the app while driving. Set your destination before you start moving, or have a passenger do it. Use voice guidance and keep your eyes on the road.

The Service may direct you onto routes that are longer, slower, unlit, unpaved, unfamiliar, restricted, or unsuitable for your vehicle. You are solely responsible for deciding whether a route is safe and lawful for you to drive.

You accept all risk arising from your driving and your use of the Service.

4. Lawful use only

You agree to use the Service only for lawful purposes. You may not use it to evade, obstruct or interfere with law enforcement, to commit or conceal any crime, to flee the scene of an incident, or to avoid a lawful order, warrant, summons, court order, or any legal obligation.

You may not use the Service to follow, locate, harass, stalk, intimidate or endanger any person, or to interfere with, damage, disable, obstruct or tamper with any camera, sensor or other equipment.

You may not trespass, enter restricted areas, or break any law in order to observe or record camera locations.

You may not scrape, bulk-download, resell or redistribute data from the Service except as the underlying data licences allow; reverse engineer or tamper with the app or our servers; attempt to access data belonging to other users; or use automated means to overload or abuse the Service.

5. Accounts

An account is optional. Without one you can still plan routes and receive alerts; an account adds saved places, saved routes, trip history and settings that follow you between devices.

Keep your password confidential. You are responsible for activity under your account. Tell us promptly if you believe it has been compromised.

You can delete your account at any time from within the app, which permanently removes your account data.

We may suspend or terminate accounts that breach these terms, that create legal risk for us or others, or where we are required to do so.

6. Camera reports you submit

If you report a camera, you confirm that you personally observed it, that your report is accurate to the best of your knowledge, and that you gathered the information lawfully and safely.

Do not submit reports about private individuals, personal information, or anything that is not a publicly visible piece of surveillance equipment.

You grant us a worldwide, non-exclusive, royalty-free licence to store, reproduce, modify, publish and distribute your reports as part of the Service, including contributing them to open data projects such as OpenStreetMap under those projects' licences. You keep whatever rights you had in the content.

We may review, edit, reject or remove any report at our discretion. Reports may be visible to other users once approved.

7. Our app, and what you may not do with it

NitoPath — its name, logo, design, screens, layout, wording, graphics, code, server logic and the methods it uses to plan routes — belongs to NitoPath or its licensors, and is protected by copyright, trademark and other laws. Using the Service gives you no ownership of any of it.

You get a personal, limited, non-exclusive, non-transferable, revocable licence to use the app on devices you control, for your own use. Everything not expressly granted is reserved.

You may not copy, reproduce, adapt, translate or create derivative works from the app or any part of it; reverse engineer, decompile or disassemble it, or otherwise try to discover its source code or how its server-side features work, except to the extent the law expressly permits despite this restriction; remove or obscure any notice of ownership; rent, lease, sell, sublicense or redistribute it; or scrape, harvest or bulk-extract its screens, content or data.

You may not use the Service, or anything you take from it, to build, design or operate a product or service that competes with NitoPath, or to help anyone else do so. That includes copying its screens, flows, wording, graphics, icons or the specific way its features behave, and includes using its output to train machine learning models.

Camera locations come from OpenStreetMap and are open data under the ODbL. That data is not ours, and nothing in this section restricts the rights that licence gives you in it. What is ours is this app: its software, its design, and the way it works.

8. Third-party data and services

Camera locations come from OpenStreetMap contributors and are licensed under the Open Database License (ODbL). Map display uses Google Maps and is subject to Google's terms. Routing and address search use openrouteservice (HeiGIT) and, as a fallback, Photon by Komoot and OSRM.

Your use of those parts of the Service is also subject to those providers' terms and privacy policies. We do not control them and are not responsible for their content, availability or accuracy.

The Service depends on these free and community services. They can be slow, rate-limited, or unavailable, and features may stop working without notice.

9. The Service is provided "as is"

To the fullest extent the law allows, the Service is provided as is and as available, without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that the Service will be uninterrupted, timely, secure, accurate, complete, or error-free, or that camera data reflects reality at any moment.

10. Limitation of liability

To the fullest extent the law allows, neither NitoPath nor anyone involved in creating or delivering the Service is liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill, or for personal injury, death, property damage, vehicle collision, traffic citation, arrest, prosecution, fine, or any other loss arising out of or relating to your use of, or inability to use, the Service.

Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or twenty-five US dollars (US$25).

Some places do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of this section may not apply to you. Nothing in these terms limits liability that cannot be limited by law, including for fraud, or for death or personal injury caused by negligence where that limitation is prohibited.

11. Indemnity

You agree to indemnify and hold harmless NitoPath and its officers, employees and contractors from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising from your use of the Service, your breach of these terms, your violation of any law, or your infringement of anyone's rights.

12. Changes

We may change the Service or these terms. If we make a material change to these terms we will ask you to accept the new version in the app. Continuing to use the Service after that means you accept the change.

We may add, change, limit or remove features, including paid features, at any time.

13. Ending this agreement

You may stop using the Service and delete your account at any time. We may suspend or end your access if you breach these terms.

Sections that by their nature should survive termination — including lawful use, liability limits, indemnity and governing law — survive.

14. Governing law and disputes

These terms are governed by the laws of the United States, without regard to conflict-of-laws rules. Courts located in the United States have exclusive jurisdiction, and you and we consent to their jurisdiction and venue.

Nothing here removes any right you have to bring a claim in your local courts where the law gives you that right.
